MetaHomes refers to the project branded and operated by Metaworld Technology FZ-LLC (“we”, “us”, “our”, the “Company”), including all associated trademarks, logos, service marks, brand names, and intellectual property rights related thereto.

- DEFINITIONS
- “Platform” refers to the MetaHomes Online Platform, website (including its website (https://www.metahomes.net/, blog.metahomes.net, and all sub-domains), mobile applications, services, and any related technologies, as well as any marketing materials, promotional content, and proprietary data that are owned or licensed by the Company. This Platform facilitates the connection between Real Estate Professionals, Merchants and End-Users for the purpose of listing Real Estate Property and other services provided by Merchants and End-Users seeking such services.
- “MetaHomes Life Services Platform” refers to a specific category of services available on the Platform, provided by Merchants who can list their services on the Platform. MetaHomes Life services are offered in addition to the property listings and facilitate a comprehensive experience for End-Users within the Platform. These services include, but are not limited to, cleaning and maintenance services, tour and activity booking, pest control services and pet grooming services;
- “Real Estate Professional” refers to any individual or legal entity utilizing the Platform to advertise or list properties for sale or rent, including, but not limited to, property owners, property managers, real estate developers, real estate agents and/or brokers or brokerage companies;
- “Host” refers to any individual or legal entity who provide vacation or holiday home rental services through the Platform;
- “Merchant” may refer to any service providers who are individuals or legal entities providing services through the MetaHomes Life Services Platform.
- “You”, “Your” or the “User” refers to any Real Estate Professional, Host or Merchant;
- “End-User” refers to any individual or legal entity, such as guests, customers, renters, or buyers, who access or utilize the Platform to browse, inquire about, or book properties for sale, rent, or vacation purposes. This includes individuals who engage with services listed under MetaHomes Life Services through the Platform. Essentially, an End-User is anyone who interacts with the Platform to obtain information, make bookings, access information or rent or buy property or access and obtain supplementary services provided through the Platform;
- “MetaHomes Real Estate Brokerage L.L.C” hereinafter referred to as MetaHomes Brokerage is a real estate brokerage company which is affiliated with the company and engaged in real estate brokerage activities including the sale, purchase and rental of properties;
- “Real Estate Property” for the purpose of these Terms, refers to land, buildings, holiday homes and properties (residential and commercial spaces) which are listed on the Platform for the purpose of buying, selling and/or renting (short-term and long-term rentals);
- "Total Customer Payment" refers to the total amount (inclusive of all applicable VAT) paid by an End-User for a service offered by Hosts through the Platform or a service offered by Merchants through the MetaHomes Life Services Platform;
- "Base Sale Amount (Excl. VAT)" refers to the Total Customer Payment excluding the 5% VAT component;
- "Service Fee" refers to 13% of the Base Sale Amount charged by the Company as a service fee;
- “Platform Fee” refers to 3% of the Total Customer Payment charged by the Company for usage of the Platform or MetaHomes Life Services Platform and is applied whenever an End-User qualifies for any types of refund;
- “Merchant Net Amount” refers to the final value after the Service Fee has been deducted from the amount paid by the End-User for the service provided by the Merchant;
- “Content” means any and all content in respect of (i) a Listing, including, but not limited to, details such as photographs, images, videos, prices, amenities, distances, plans etc.; (ii) your details, including the photographs and details of your employees, contractors, licensed agents and/or brokers; and (iii) your Intellectual Property Rights;
- “Listing” means the Content in respect of a Real Estate Property displayed by a Real Estate Professional or Host and services displayed by a Merchant on our Platform;
- “Listing Term” means the period during which your Listing will be displayed on our Platform;
- “User ID” is a unique identifier, often a username or number (or a combination of both), used by the Platform to distinguish and track a specific User’s or End-User’s account and activity;
- “Applicable Law(s)” refers to any and all laws, regulations, rules, directives, and guidelines enforced by governmental, regulatory, or judicial authorities within the United Arab Emirates. These legal requirements are binding upon the parties engaged under these Terms and are subject to change as they may be amended or updated periodically;
- “Data Protection Laws” means those laws applicable to the collection and processing of personal data in applicable jurisdictions;
- “Intellectual Property Rights” means all patents, rights to inventions, utility models, copyright and related rights, trademarks, trade names, logos, service marks, trade, business and domain names, rights in trade dress or get-up, rights in goodwill or to sue for passing off, unfair competition rights, rights in designs, rights in computer software, database right, topography rights, moral rights, rights in confidential information (including know-how and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered and including all applications for and renewals or extensions of such rights, and all similar or equivalent rights or forms of protection in any part of the world;
- “Confidential Information” refers to non-public, sensitive data shared under an expectation of privacy, often with commercial value or strategic importance, that a disclosing party seeks to protect from unauthorized use or disclosure;
- “Property Management Contract” refers to an Agreement that a Real Estate Professional may enter into with the landlord of a Real Estate property;
- “Advertising Agreement” refers to an Agreement that a Real Estate Professional or Host enters into with the Company to regulate the terms governing their listing rights on the Platform;
- “Commission and Referral Arrangement” refers to a set of agreements to be signed between a Real Estate Professional and MetaHomes Brokerage once an End-User indicates expresses interest in a Real Estate Property;
- “Cancellation and Refund Policy” refers to the Cancellation and Refund Policy available at https://www.metahomes.net/refund-policy;
- “Privacy Policy” refers to the Privacy Policy available at https://www.metahomes.net/privacy-statement.
- BY USING THE PLATFORM, YOU ACCEPT THESE TERMS AND CONDITIONS
3.1 By using or accessing the Platform, you or the End-User agree and confirm that you have read, understood, and accept these terms and conditions (“Terms”) thoroughly as the Terms which govern your and the End-User’s access to and use of the Platform and the service, and you agree to comply with them. If you do not accept or agree to comply with these Terms and be bound by them, you may close your MetaHomes account at any time and no longer access or use the services.
- WE MAKE CHANGES TO THESE TERMS AND CONDITIONS
4.1 We amend these Terms from time to time. Every time you or an End-User wish to use the Platform, please read these Terms carefully, as they contain important information about legal rights and the limitations of those rights, as well as information about applicable law and dispute resolution. If you or an End-User do not fully agree to these Terms and any other terms and conditions listed in our Platform, you or an End-User are not authorized to access or otherwise use the Platform. Please check these Terms to ensure you understand the Terms that apply at that time. These Terms were most recently updated in [October 2025].
- WE MAY MAKE CHANGES TO THE PLATFORM
5.1 We may change the way the Platform operates and/or change any Content from time to time without notice to you or an End-User. This could be, for example, to reflect changes to the features and functionalities of the Platform, the state of current technology, or market practice, Applicable Law and/or our business priorities.
- WE MAY SUSPEND OR WITHDRAW THE PLATFORM
6.1 We do not guarantee that the Platform and/or any Listing will always be available free of charge, or generally available. We may suspend or withdraw, or restrict the availability of, all or any part of the Platform for business and/or operational reasons.
- YOUR PRIVACY
7.1 Please refer to our Privacy Policy to understand how we collect, process and share yours or an End-Users personal data in relation to your use of the Platform. Please read these Terms carefully, as they contain important information about legal rights and the limitations of those rights, as well as information about applicable law and dispute jurisdiction. If you do not fully agree to these Terms and/ or any other terms and conditions available on the Platform, you are not authorized to access or otherwise use the Platform. If you wish to terminate these Terms, you may close your MetaHomes account at any time and no longer access or use the services.
- ELIGIBILITY CRITERIA
8.1 Users and End-Users are not authorized to use the Platform unless the following eligibility criteria are met. By using the Platform, Users and End-Users agree and confirm they are:
- Not a minor under the age of 18;
- At least 18 years of age (or older, subject to the applicable jurisdiction) and have the legal capacity to enter into binding contracts;
- If registering as a business entity, the User and End-User represent and guarantee that they have the authority to bind the entity to these Terms;
- If the User and End-User are acting on behalf of a third party or another entity, they confirm they have the proper authorization to do so.
- RESPONSIBILITIES
- Users and End-Users should ensure that they understand and comply with all applicable Terms;
- The User must act responsibly when using the Platform and engaging in transactions related to property listings, rentals, sales or listing of its services;
- Users and End-Users are responsible for maintaining the confidentiality of their account;
- Users and End-Users are responsible for adhering to all Applicable Laws while using and engaging in any transactions on the Platform. This includes, but is not restricted to, compliance with any laws relevant to the use of services offered through the Platform;
- Real Estate Professionals are responsible for ensuring that their property listings related to rental or sale activities comply with all Applicable Laws. This includes, but is not limited to, compliance with tax laws, safety standards, and obtaining any necessary permits or licenses;
- Users and End-Users agree to provide truthful, complete, and accurate information during their registration and throughout their use of the Platform. You are responsible for keeping your information, documents, licenses and permits accurate and ensuring it remains up-to-date;
- Real Estate Professionals, Hosts and Merchants agree to promptly notify the Company of any changes to their information, documents, licenses, permits, listings, or contact details, including, but not limited to, property details, availability, and other relevant information;
- It is the Real Estate Professional’s, Host’s and Merchant's responsibility to inform the Company of expired documents, including, but not limited to, permits and licenses, and to submit valid replacements fifteen (15) working days prior to its expiry.
- LIMITED LICENSE TO USE METAHOMES
- Subject to the continued compliance with these Terms, the Company grants Users and End-Users a limited, revocable, non-exclusive license to access and use the Platform, including its content and services, solely for the following purposes:
- Advertising a property for sale, rent, or other services;
- Searching for properties, researching, or inquiring about purchasing properties;
- Purchasing or inquiring about any products or services offered on the Platform;
- Participating in interactive areas, forums, or communication channels hosted on the Platform;
- Engaging in any other activities expressly stated as permissible on the Platform.
- Any use of the Platform that is not for one of these purposes or otherwise in accordance with the Terms or as otherwise authorized by us in writing is expressly prohibited.
- UNAUTHORIZED USE OF METAHOMES
- The license to use the Platform only extends to the specific Users and End-Users described in these Terms.
- Unauthorized use of the Platform includes, but are not limited to, the following:
- The right to collect, aggregate, copy, scrape, duplicate, display, or create derivative uses of the Platform;
- The use of data mining, robots, spiders, or similar data extraction tools, unless explicitly authorized by the Company in writing;
- Unless however, they are general-purpose internet search engines that gather information solely for the purpose of displaying hyperlinks to the Platform. These search engines must operate from a stable IP address or range of IP addresses, use an easily identifiable agent, and comply with our robots.txt file. This exception does not apply to websites or search engines that provide classified listings, property rental/sales advertisements, or similar services that compete with MetaHomes, including any service operating in the property rental/sales sector;
- Any commercial use of the Platform or its content, other than by Real Estate Professionals/ Hosts/Merchants in good standing or those licensed to use the software of the Platform;
- Using the Platform or its tools for booking or soliciting rental/ sale transactions for properties not listed on the Platform;
- Copying, reproducing, uploading, posting, displaying, republishing, distributing, or transmitting any content from the Platform in any form;
- Reproducing any portion of the Platform on your platform, using framing techniques or mirroring any content;
- Deep linking to any portion of the Platform without our express written permission;
- Modifying, translating, or creating derivative works from any Content or part of the Platform;
- Reverse engineering any part of the Platform;
- Selling, offering for sale, transferring, or licensing any portion of the Platform to third parties;
- Posting or transmitting false, fraudulent, or misleading information, or engaging in any activity under false pretenses, such as phishing;
- Posting or transmitting unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, sexually explicit, pornographic, or profane material;
- Posting any reviews that are intended to harm the Company's reputation or defame any of its employees;
- Violating the intellectual property rights of MetaHomes or third parties, including copyright, trademark, or patent infringement;
- Using the Platform in any way that negatively impacts the Platform's performance or functionality;
- Users and End-Users must not use the Platform in any unlawful manner or for any unlawful purpose;
- Users and End-Users must not impersonate any other person while using the Platform;
- Real Estate Professionals, Hosts and Merchants must not use the Platform to generate unsolicited advertisements or spam;
- Users and End-Users must not reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purpose all or any portion of the Platform or any Content;
- Users and End-Users must not use manual methods or any software, devices, scripts, robots or any other means or processes (including so-called ‘spiders’, ‘bots’ and ‘crawlers’) to scrape the Platform and/or its Content, or otherwise create or compile (in single or multiple downloads) a collection, compilation, database or directory from the Platform or its Content, or bypass or seek to bypass any robot exclusion headers we may implement
- Users and End-Users must not reverse-engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Platform and/or its Content.
- We will report any breach of the restrictions listed above to the relevant law enforcement authorities and will cooperate with those authorities by disclosing your identity to them. If you are aware of, or experience, any Content, activity, or communication through or in connection with the Platform that appears to be in violation of the above restrictions or any other provision of these Terms however, we ask that you please inform us by contacting us as set forth under “Contact Us” below.
- COPYRIGHT NOTICE OF METAHOMES
- MetaHomes, including its name, logo, and all Content, materials, and information on the Platform, are protected by copyright, trademark, and other Applicable Laws. The MetaHomes logo and associated marks are used under a valid license agreement and are the property of the Company. All rights are reserved.
- By accessing and using the Platform, you acknowledge that MetaHomes, its trademarks, and all Content and materials provided on the Platform are the exclusive property of the Company, its affiliates, or licensors, and you agree to abide by any and all copyright, trademark, and intellectual property rights related to them.
- Copying, storing, modifying, displaying, distributing, or otherwise using MetaHomes, its name, logo, or any Content on the Platform for any commercial purpose, other than in accordance with a valid Listing, is expressly prohibited without prior written permission from the Company or the respective rights holders.
- You agree not to infringe upon the intellectual property rights of MetaHomes, and you acknowledge that the rights to all Content and materials on the Platform, unless otherwise noted, are owned by the Company or third-party licensors.
- We respect the intellectual property rights of others. The Company does not permit, condone, or tolerate the posting of Content on the Platform that infringes the copyright or intellectual property rights of any third party. If you become aware of or suspect any copyright infringement on the Platform, please notify us in accordance with the terms mentioned herein. In appropriate circumstances, the Company will terminate the accounts of the Users who infringe copyrights.
- USAGE AND PROTECTION OF DATA
- We value and prioritize your privacy. For further details on how we collect, use, and protect your personal data, please refer to our Privacy Policy.
- When you provide your email address, name, contact information, or any other personal data in connection with your use of the Platform or any services, features, or tools provided by the Company, you agree to allow the Platform and its affiliated websites to collect and store your personal data in our user database. This may include details of User and End-User, but is not limited to, your name, email address, and any other information you provide to us during registration or usage. By submitting such information, you consent to receive promotional communications, updates, or newsletters from the Platform or its affiliated websites. You may choose to opt-out of receiving such communications at any time by following the unsubscribe instructions provided in such emails or by contacting us directly.
- The Company adheres to strong privacy practices to safeguard your personal information. You agree that we may access and use your User-Generated Content (as defined in section 16) in accordance with these Terms and our Privacy Policy. We further agree that we will disclose your personal information only as necessary to comply with legal obligations, protect our rights, or as otherwise set forth in our Privacy Policy.
- You have the right to request access, correction, or deletion of your personal data held by the Company in accordance with applicable data protection laws. If you wish to exercise these rights or if you have any questions regarding how your data is handled, please contact us as specified in the "Contact Us" section.
- IDENTITY VERIFICATION
- User verification on the internet is inherently challenging, and the Company cannot and does not guarantee the identity of any individual User. While we provide tools for communication between End-Users, Real Estate Professionals, Hosts, and Merchants via the Platform, these tools do not guarantee the accuracy of the User’s identity. We strongly encourage End-Users to exercise caution and verify the identity of individuals with whom they are interacting on the Platform.
- We recommend that End-Users take additional reasonable measures to verify the identity of other parties. For End-Users, this includes confirming the Real Estate Property and relevant details of your booking or proposed rental or purchase. We encourage thorough communication, review of property Listings, and possibly independent verification of information before proceeding with any transactions.
- Both Users and End-Users are required to create an account, which includes establishing a unique User ID and password, to access and utilize the Platform.
- You are solely responsible for maintaining the confidentiality of your Platform’s account credentials, including your User ID and password. By agreeing to these Terms, you undertake to:
- Keep your account password and User ID secure and confidential and share it only with authorized individuals;
- Should you forget your password, you may initiate a password reset through the Platform's designated process;
- Instruct any person to whom you provide your credentials not to disclose it to any unauthorized person;
- You acknowledge that if you choose to share your credentials, you do so at your own risk, and that the Company shall not be liable for any loss, damage, or unauthorized access resulting from such disclosure;
- Notify the Company immediately if you suspect any unauthorized access to your MetaHomes account or your email account and promptly select a new password and User ID;
- Notify the Company immediately if you are contacted by any individual or entity requesting your account details, User ID, or password.
- If the Company suspects any unauthorized access to your account, we reserve the right to request that you promptly change your User ID and password. You agree to cooperate with the Company in taking reasonable actions to secure your account, including complying with any other security measures or instructions we may require.
- We discourage you from sharing your User ID and password with any third party. However, if you choose to share your credentials or fail to secure your account details, you are responsible for any and all actions performed through your account, including unauthorized or fraudulent transactions. This includes transactions that you did not intend or authorize.
- Users and End-Users acknowledge and agree that neither the Company nor its affiliates will be liable for any unauthorized transactions made using your account credentials. You understand that if your account or email credentials are used without your authorization, you may be liable to both the Company and other Users for any resulting damages, losses, or legal actions.
- The Company reserves the right to suspend, cancel, or deactivate your account or Listing at any time, with or without notice, if we reasonably suspect that your account is being used in an unauthorized, fraudulent, or unlawful manner. This action may be taken at our sole discretion and without prior notification to you.
- COMMUNICATIONS BETWEEN USERS AND END-USERS
- You agree that any personal information you obtain directly or indirectly from another User or End-User via the Platform, or through any related communication, transaction, or software on the Platform, is strictly for the purpose of facilitating communication relevant to the Listings listed on the Platform. Such communication may include, but is not restricted to, inquiries about Real Estate Properties, booking arrangements, or any necessary correspondence for financial transactions. A User may not use this information for unsolicited commercial messages or for any unlawful purpose without the express permission of the End-User from whom the information was obtained.
- Users agree that, in all cases, if you collect or store personal information about End-Users (such as email addresses or phone numbers), you must provide them with a way to opt-out or remove their information from your address book, database, or records. Under no circumstances may you disclose any personal information about another User or End-User to third parties, unless explicitly authorized by the User or End-User in accordance with these Terms.
- The Company has a zero-tolerance policy toward spam or unsolicited communications. As a platform, we are committed to actively monitoring and enforcing this policy. You are not permitted to add any End-User, whether they have rented or purchased a Real Estate Property from you or not, to your mailing list (email or physical mail) without their explicit consent. Users are also prohibited from using the Platform to send spam, unsolicited commercial messages, or any form of mass marketing that violates these Terms.
- If we become aware that a User is attempting to solicit or contact other Users or End-Users by obtaining their personal information (such as email addresses or phone numbers) from the Platform without consent, we reserve the right to report their behavior to the relevant authorities. Please be aware that violations of UAE cybercrimes law may lead to legal action taken against you resulting in severe penalties, including imprisonment.
- USER-GENERATED CONTENT
- The Company does not undertake any obligation to pre-screen, review, or monitor Content submitted by Users, including, but not limited to, Real Estate Property Listings, Real Estate Property reviews, feedback on agents, or any other content provided by Users or third parties on behalf of Users (collectively, “User-Generated Content"). The Company does not guarantee the accuracy, completeness, or reliability of such User-Generated Content and expressly disclaims any responsibility for it.
- Users are solely responsible for the Content they post or provide on the Platform. They agree that they will exercise caution and due diligence in uploading, sharing, or submitting any Content. The Company disclaims any and all liability for the accuracy, ownership, or authorization of any Content posted by Users. It is your responsibility to ensure that you have all the necessary rights, permissions, and licenses/permits/NOCs to use, post, and share the Content on the Platform. The Company does not assume any liability for any claims arising from the use or misuse of User-Generated Content, including copyright infringement or other violations of third-party rights.
- While the Company does not have a general obligation to monitor User-Generated Content, it reserves the right to review, monitor, and remove any Content that violates these Terms, or is deemed inappropriate, misleading, or otherwise unsuitable, at the Company’s sole discretion.
- In the event that any User-Generated Content is flagged by a User or End-User or brought to the Company’s attention through any other means, we reserve the right to investigate and remove such Content if it is found to breach these Terms or any Applicable Laws, as determined by the Company at its sole discretion.
- The Company may, at its discretion, make non-substantive edits to User-Generated Content solely for compliance with formatting guidelines or to ensure adherence to the Platform’s Content standards. This may include, but is not limited to, modifications related to translations, layout, or minor corrections to improve clarity or consistency.
- By submitting User-Generated Content, you represent and warrant that you have the necessary legal rights to the Content and that the Content does not infringe on the intellectual property rights, privacy rights, or any other rights of any third party. You further warrant that such Content complies with all Applicable Laws and does not violate any of the prohibitions set forth in these Terms.
- Specifically, you agree that your User-Generated Content will not:
- Infringe the intellectual property rights of MetaHomes and others, including, but not limited to, copyright, trademark, or rights of publicity, or violate any applicable law;
- Contain personal or confidential information of any third party, including identifying information such as email addresses, phone numbers, or any information that could be used to contact another individual without their consent;
- Include unsolicited advertisements, promotional materials, political campaigns, or other types of solicitation;
- Be unrelated to the specific purpose of the Platform, including, but not limited to, the listing, renting, or selling of properties, or the provision of vacation rental services;
- Contain false, misleading, defamatory, libelous, obscene, vulgar, harassing, threatening, or offensive material, or any content that promotes illegal activity or violates any other applicable laws or regulations;
- Misrepresent your relationship with any person or entity, including the Company, or impersonate any person or entity;
- Introduce harmful software, viruses, or any other malicious code that could damage or interfere with the operation of the Platform or other Users' devices or systems.
- Users, whether acting as Real Estate Professionals or Hosts or Merchants, are solely responsible for the accuracy, legality, and completeness of the Real Estate Property Listings they submit to the Company. The Company expressly disclaims any liability for inaccuracies or disputes arising from Real Estate Property Listings, reviews, or any breach of contract that may occur between a User and an End-User.
- Real Estate Professionals and Hosts are responsible for ensuring that the information they provide about their Real Estate Properties, including, but not limited to, pricing, location, availability, and amenities are accurate and up to date. The Company does not verify or guarantee the accuracy of any Real Estate Property Listing Content submitted by them.
- The Company makes no representations or warranties regarding the accuracy, completeness, or timeliness of Real Estate Property Listings, reviews, or other Content available on the Platform. All End-Users are encouraged to independently verify the details of any Real Estate Property before making a purchase or rental commitment.
- The Company may, at its discretion, modify Real Estate Property descriptions or geographic identifiers used to categorize and display Listings on the Platform. Such changes may be made without notice and may affect the location or description of listed Real Estate Properties.
- Notwithstanding the above, the Company assumes no responsibility for verifying the Content or location of any Real Estate Property Listing, and Users are solely responsible for maintaining accurate Real Estate Property details. End-Users are advised to confirm any details related to a Listing, including location, amenities, and availability, prior to making a reservation.
- All other User-Generated Content on the Platform, including reviews, comments, and feedback, is the sole responsibility of the User who contributed it. The Company disclaims any liability for such Content and does not endorse or guarantee the accuracy or completeness of any User-Generated Content.
- By submitting User-Generated Content, you represent and warrant that you either own the Content or have obtained all necessary rights and permissions to submit such Content. The Company reserves the right to request proof of ownership or permission and may refuse to post or remove any Content if such proof is deemed insufficient by the Company at its sole discretion.
- By submitting Content to the Company, you grant the Company and its affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, display, and otherwise exploit the Content in any manner, including for promotional purposes. This license includes the right to sublicense the Content to third parties.
- Notwithstanding the above, upon the expiration or termination of a Real Estate Property Listing, the Platform will no longer display any User-Generated Content associated with that Listing.
- The Company reserves the right to assist Users in protecting their User-Generated Content, including, but not limited to, providing support in claims for copyright infringement or seeking injunctive relief to prevent the unauthorized use of such Content by third parties. While the Company does not assume responsibility for taking legal action on behalf of Users, we will, upon request, cooperate with Users and assist them in enforcing their rights regarding the unauthorized use or distribution of their User-Generated Content.
- You acknowledge and agree that the Company may sublicense the rights granted to it under these Terms to third-party service providers or affiliates for the purpose of promoting or distributing User-Generated Content.
- To the extent permitted by law, you waive any moral rights or other rights of attribution or integrity in the User-Generated Content submitted to the Company and consent to the use, modification, and exploitation of such Content in any manner by the Company or its affiliates.
- TERMINATION OF LISTINGS AND OTHER REMEDIES
- The Company reserves the right to limit or terminate a User’s use of the Platform, restrict the visibility of their Listings, or remove their Listings entirely under the following circumstances:
- If a User submits inappropriate, illegal, or misleading material;
- If a User violates local rental, sale, or other relevant regulations;
- If a User’s actions negatively impact the Platform or its community;
- If a User misuses the Platform or system, including engaging in fraudulent activity.
- As the Platform is directly integrated with the Dubai Land Department (DLD) trakheesi system, our system runs a daily check to automatically validate all Real Estate Property Listings. If a permit has expired, the Real Estate Property is flagged and moved to the “invalid DLD” section, after which it is unpublished.
- When uploading or updating Listings, we manually verify the permit and Listings with valid permits are approved, while invalid ones are rejected.
- When a Listing is marked as “sold”, we proceed to move it to this section. Since we rely on the trakheesi system, if the permit reflects that the property is no longer available or has been sold, we promptly unpublish it.
- If the Company receives a complaint or identifies conduct that violates the Platform's standards, it may result in the immediate removal of the Listing or termination of a booking, without prior notice to the User. Examples include, but are not limited to:
- Double-booking a property or engaging in unfair or deceptive practices.
- Suspecting that the User’s payment-related practices are not secure, legal, or compliant.
- Receiving complaints that the User’s Content infringes the rights of a third party (e.g., intellectual property infringement).
- If a User engages in abusive, offensive, or inappropriate behavior towards any employee or representative of the Company, the Company reserves the right to immediately remove the User’s Listing or booking, without a refund (if applicable).
- In addition to terminating or removing Listings, the Company reserves the right to take other actions in response to any violation of these Terms, including but not limited to:
- Removing a Listing from search results;
- Marking the User as a “non-authenticated user”;
- Removing or modifying information that may be misleading or false.
- SERVICE FEE PAYABLE BY END-USERS
- The Company charges a Service Fee for the services provided by Hosts and Merchants. This fee and the specific details of the Service Fee, including its application and payment terms, will be outlined in a separate agreement between the Company and the Hosts and Merchants and further described in the Cancellation and Refund Policy.
- The Service Fee, for Hosts and Merchants, is included in the payments made by End-Users who rent holiday homes or purchase other services through the MetaHomes Life Services Platform. The Company will provide the payment processing facility through the Platform and deduct the Service Fee which includes, but is not limited to, the payment gateway fee, Platform maintenance, and other related services.
- Depending on the applicable laws in the jurisdiction of the Host, Merchant or End-User, VAT may be applied to the Service Fee. The exact Service Fee amount will be displayed to End-Users at the time of booking. The Service Fee will be charged once the End-User confirms the reservation.
- The Host and Merchant agree not to encourage, facilitate, or advise End-Users in any manner to circumvent, evade, or avoid the Service Fee charged by the Company.
- SOCIAL MEDIA OR THIRD-PARTY WEBSITES
- The Company may, from time to time, initiate collaborations and promotional activities that involve leveraging or integrating with the User’s publicly available social media content and profiles. The User agrees to participate in such collaborations upon mutual written consent.
- If any social media content is misclassified as public, inaccurate, or otherwise disagrees with your preferences, you agree to work directly with the relevant social media profile to make changes or resolve any disputes. You acknowledge that the Company will not be responsible for providing recourse in such cases.
- The Platform may contain links and pointers to other internet sites, resources, and sponsors. Links to and from the Platform to other third-party sites, maintained by third parties, do not constitute an endorsement by the Company of any third parties or the contents thereof.
- The Platform may also provide tools to allow interaction between the Platform and a third-party site, such as a social media site. However, the Company is not responsible for any third-party sites or resources.
- You agree to use such third-party websites and resources at your own risk. We recommend that you review the terms, conditions, and privacy policies of any third-party websites and applications before using them.
- TRANSLATIONS AND MAPS
- If any User-Generated Content, including, but not limited to, Listings or descriptions provided by Users, is translated for display on the Platform or any affiliate site of the Company, we do not guarantee the accuracy, completeness, or quality of such translation. The User is solely responsible for reviewing, verifying, and ensuring the accuracy of any translated Content.
21. IDEAS AND FEEDBACK
- Users may submit ideas, suggestions, or feedback related to the Platform, including, but not limited to, ideas for new or improved products, technologies, website or tool enhancements, marketing plans, or new product names. While the Company is under no obligation to review, consider, or act upon any submissions provided by Users, we may, at our discretion, take them into consideration.
- If you choose to submit any ideas, original creative works, suggestions, or other materials (collectively, "Submissions"), the following terms will apply, regardless of the form or medium through which such Submissions are made.
- These Terms are intended to prevent any misunderstandings or disputes in the event that any part of the Company' business, such as our products, platforms, websites, apps, technologies, or marketing strategies, appears similar to your Submissions.
- By submitting any Submissions, you agree that:
- Your Submission and its Contents will automatically become the exclusive property of the Company, without any compensation to you.
- The Company has the right to use, modify, distribute, or otherwise exploit any Submission and its Contents for any purpose, in any manner, and without any further obligation to you.
- There is no obligation for the Company to review or respond to any Submission.
- The Company is not obligated to keep any Submission confidential.
- AI-POWERED PLATFORM AND SOFTWARE SERVICES
- The Company provides an AI-powered Platform which uses artificial intelligence algorithms to provide an efficient property search, recommendation, and booking service for End-Users. All AI-driven tools, software, and technologies used on the Platform are the intellectual property of the Company, its affiliates, or identified third-party licensors. All rights to such software are reserved.
- The Company grants Users, and End-Users a limited, personal, non-transferable, non-exclusive license to use the AI-powered Platform and services for the purposes specified in accordance with these Terms. This license is granted only for personal, non-commercial use and may not be used for any other purpose without the express written consent of the Company or applicable third-party licensors.
- The AI-powered services, including, but not limited to, the Listings on the Platform, recommendations, and booking systems, are provided "as is" and are warranted only in accordance with any additional license agreement, if applicable. Copying, reproducing, modifying, distributing, or creating derivative works based on the AI-powered software or services is strictly prohibited unless expressly authorized.
- You agree not to reverse engineer, decompile, disassemble, or attempt to discover the underlying source code of the AI algorithms or any other proprietary software associated with the Platform, except to the extent permitted by Applicable Law.
- The Company reserves the right to update, modify, or discontinue the AI-driven services, software, or any features on the Platform at its discretion. Any updates or changes to the Platform will be governed by these Terms unless specifically stated otherwise. Users acknowledge that any Real Estate Property Listings or other related services submitted to the Company may be processed and displayed using AI algorithms, and it is the User’s responsibility to ensure that their Listings and/or associated Content are accurate and up to date.
- ADDITIONAL TERMS GOVERNING HOSTS
- In order to list a Real Estate Property on the Platform, Hosts must comply with MetaHomes’ marketplace standards. These standards include, but are not limited to:
- Maintaining an accurate reservation calendar.
- Responding to booking requests within 24 hours.
- Accepting a reasonable number of inquiries and bookings to ensure a positive guest experience.
- Refraining from cancelling a material number of confirmed bookings.
- Hosts represent and warrant that:
- They are required to sign an Advertising Agreement. This document will formally establish the legal relationship between you and the Company. Hosts who have already listed properties on the Platform prior to October 2025, must also sign this new agreement to ensure a smooth transition and continued service;
- They either own or have the necessary rights to rent out the Real Estate Property listed on the Platform and must not wrongfully withhold rental deposits;
- They are responsible for ensuring the accuracy of their Listings, including descriptions, photos, and details about the Real Estate Property’s condition, location, and amenities;
- They agree not to wrongfully deny access to the listed Real Estate Property to End-Users who have made a valid reservation;
- They must provide, upon request, documentation verifying ownership, accuracy of Listing Content, and their authority to list the Real Estate Property as requested by the Company;
- If a Host is a tenant, they must confirm with their landlord whether their lease agreement permits sub-leasing and listing the Real Estate Property on the Platform;
- If the Hosts are utilizing any tools provided by the Company or third-party providers that enable online booking and payment for Real Estate Property rentals and bookings (collectively referred to as the “Reservation Services”), they agree to be bound by the following additional terms. These terms supplement any other applicable terms and conditions for using the Platform;
- If you do not agree to these additional Terms, you do not have the right to access or use the Platform.
23.4 Payment method policy for Hosts:
- The Host agrees that they shall not request any End-Users to make payments by cash via email, or utilize any instant-cash wire transfer services, including, but not limited to, western union or moneygram, for any part of the rental transaction conducted through the Platform. The Host acknowledges that such payment methods are not acceptable through the Platform.
- Any violation of this payment method policy, or any other payment method deemed unacceptable by the Company, may result in the immediate removal of the Listing from the Platform. This action will be taken without prior notice to the Host and without any refund of fees paid by the End-User.
- From time to time, the Company may become aware of attempts by End-Users to conduct transactions involving unauthorized or fraudulent payment methods. While the Company endeavors to assist in preventing such transactions, the Company assumes no liability or responsibility for identifying, preventing, or informing Hosts of any fraudulent or unauthorized activity.
- The Host acknowledges that End-Users may incur certain fees imposed by their banks or credit card companies, including, but not limited to, foreign transaction fees, related to the rental of Real Estate Properties on the Platform. These fees are beyond the control of the Company.
- Hosts are responsible for reviewing and understanding any fees or charges that may be imposed by the End User's bank or credit card company in connection with a transaction. The Company will not be held responsible for any such fees or for resolving disputes between the End-User and their financial institution.
- The Host agrees not to intentionally provide false or misleading information when using the Platform's online payment services. This includes, but is not limited to, providing false information during transaction processing, listing creation, or payment procedures.
- The Host agrees not to falsify, forge, or tamper with any information contained in emails received as part of the Platform’s online payment services. Any such activity will result in immediate action being taken, including the removal of Listings and suspension of the Host’s account.
- To ensure the Host’s full legal rights and payment security, it is prohibited for the Host to accept payment through a third party or to use a credit card not registered in the End-User’s name.
23.5 Additional Terms:
- The Company does not guarantee that your Listing will appear in a specific order in search results. The order of Listings is determined by various factors, such as account performance, Listing quality, Host response time, calendar updates, End-User preferences, and compliance with Platform standards.
- The Company reserves the right to use algorithms and methods to optimize the display of Listings based on factors relevant to user experience, including the "recommended match" for End-Users and the Listings distributed on third-party platforms are not guaranteed to appear in any specific order or at all.
- While the Company does not have a general obligation to monitor User-Generated Content, it reserves the right to review, monitor, and remove any Content that violates these Terms, does not comply with Content guidelines, or is deemed inappropriate, misleading, or otherwise unsuitable, at the sole discretion of the Company. In such situation, the Company reserves the right to reject or remove Content that does not meet Platform standards or is deemed unacceptable. Hosts are responsible for ensuring that all Content displayed on their Listings are accurate and represents the Real Estate Property as it is intended. Hosts should also regularly review and update their Listings as necessary.
- TERMS GOVERNING REAL ESTATE PROFESSIONALS AND END-USERS
- In addition to the general Terms, Real Estate Professionals operating through the Platform are governed by further Terms that address their relationship with the Platform. These Terms provide additional clarity and protection for all parties involved in property transactions conducted via the Platform.
- Real Estate Professionals agree to:
- Sign an Advertising Agreement. This document will formally establish the legal relationship between you and the Company. Real Estate Professionals who have already listed properties on the Platform prior to October 2025, must also sign this new agreement to ensure a smooth transition and continued service;
- Hold all necessary licenses/ permits and/or legal authorizations required by local jurisdictions (e.g., the Dubai Real Estate Regulatory Authority [RERA]) to engage in property transactions;
- Ensure that all activities are conducted in compliance with Applicable Laws, regulations, and industry standards;
- Provide truthful, complete, and accurate information in Real Estate Property Listings, including, but not limited to, details on property size, condition, location, pricing, defects, encumbrances, and any other material facts;
- Update Listings promptly when Real Estate Properties are sold, leased, or otherwise become unavailable;
- Provide potential buyers or renters with all legally required documents, including, but not limited to, title deeds, ownership certificates, permits, and any legal encumbrances on the property as applicable;
- Conduct all interactions professionally and in accordance with ethical standards. Misrepresentation, omission of critical property details, or unprofessional conduct may result in suspension or removal of Listings from the Platform;
- Submit photographs of the Real Estate Property which accurately represents the actual property and must comply with applicable intellectual property laws. Real Estate Professionals further agree that the photographs shall not include individuals unless their express legal consent has been obtained. The Company reserves the right to remove any photographs that do not meet these standards or that violate intellectual property rights;
- The Company is not liable for any such Content or for any violation of intellectual property rights arising from it. The Real Estate Professional solely bears all liability for such Content;
- Not to use MetaHomes’ name, logo, or any related trademarks in a manner that suggests sponsorship, endorsement, or affiliation with the Company, or that is otherwise misleading, is strictly prohibited;
- Comply with the Company’s right to refuse any hypertext links to or addresses of third-party websites from Real Estate Professionals' property pages. Real Estate Professionals further agree that the Company reserves the right to remove including, but not limited to, links, web addresses, email addresses or contacts numbers in the Real Estate Property description section at its sole discretion, without notice, and may charge for hypertext links at any time;
- Ensure that each Real Estate Property Listing corresponds to a specific, uniquely identified Real Estate Property.
- Further, the Real Estate Professionals listing Real Estate Properties for sale/ lease agree to:
- Represent and warrant that the property owner holds a clear and undisputed legal title to the Real Estate Property;
- Disclose all known material defects and legal encumbrances affecting the Real Estate Property, such as zoning violations, pending lawsuits, or liens, to potential buyers or renters. Failure to disclose such information may result in legal consequences and removal of Listings from the Platform;
- Ensure that all Real Estate Property details in the Listing, including size, condition, sale/lease price, and terms, are accurate and up-to-date. Providing false or misleading information may result in legal consequences, including suspension or removal of Listings from the Platform;
- Ensure that property owners will honor all commitments made in purchase or lease agreements, including delivery of legal documents, access to the Real Estate Property, and other agreed-upon terms;
- That Real Estate Properties listed on the Platform must not be substituted without the Company’s prior written consent. If the Property Management Contract for the Real Estate Property is terminated, the Real Estate Professional must provide sufficient proof, and the Listing term shall remain the same as the original listing;
- The Real Estate Professional agrees that if they submit changes to an existing Listing and if approved and it substantially alters the Listing to represent a different property, the Company reserves the right to terminate the Listing;
- Furthermore, the Real Estate Professional agrees that a single Listing may not represent multiple properties unless the property consists of multiple rental units.
- End-Users, must adhere to the following:
- Conduct their own due diligence before entering into any transaction. MetaHomes is a Platform that facilitates information exchange but does not guarantee the accuracy, completeness, or reliability of Real Estate Property Listings. The Company is not a party to any transaction and is not responsible for any agreements entered into between Real Estate Professionals and End-Users;
- Seek independent legal, financial, and property advice as needed. The Company does not provide legal, financial, or property advice and strongly recommends that End-Users seek professional guidance before entering into any agreements with Real Estate Professionals;
- Ensure that they possess the necessary financial resources and capacity to enter into a purchase or lease agreement. The Company is not responsible for assessing the financial suitability or capacity of any End-User;
- Honor any financial obligations entered into, such as mortgage commitments, rental deposits, or other contractual obligations. Failure to comply with these obligations may result in legal action, and the Company is not responsible for any legal disputes or liabilities arising from the transaction;
- Once an End-User who is a buyer or renter, enters into a formal agreement with the Real Estate Professional, they are bound by the terms of that agreement, including but not limited to, payment schedules, obligations, and penalties for breach of contract. The Company is not a party to the agreement and does not bear responsibility for its enforcement.
- All parties engaging in Real Estate Property transactions on the Platform shall comply with the applicable real estate laws as follows;
- All Real Estate Professionals and End-Users must comply with all applicable Anti-Money Laundering (AML) laws and regulations. In exceptional circumstances, the Company reserves the right to request additional documentation or proof of identity from any party involved in high-value transactions to ensure compliance with AML requirements;
- Real Estate Professionals are solely responsible for fulfilling their tax obligations related to the sale or lease of a Real Estate Property, including but not limited to any VAT, property transfer fees, or other government-imposed charges. The Company shall not be liable for ensuring or verifying compliance with tax obligations;
- Real Estate Professionals must comply with local laws regarding Real Estate Property disclosures. This includes, but is not limited to, providing End-Users with accurate details about the Real Estate Property’scondition, any environmental concerns, legal disputes, or other material facts. Failure to comply with these disclosure requirements may result in legal consequences.
24.6 Customer Handling Process:
- The Platform facilitates seamless interaction through various communication channels, offering a user-friendly experience for all parties involved. End-Users can contact the Company via:
- Tour Requests
- Phone Calls
- WhatsApp
- Social Media Platforms
- Online Calls
- User-Submitted Requests
- Booking Requests
- Chats
- When an End-User expresses interest in a Real Estate Property listed on the Platform by a Real Estate Professional, they will initiate contact with our customer support team through one of the communication mediums mentioned above. The customer support team will then direct the interested End-User to the MetaHomes Brokerage team to close the transaction.
- TERMS GOVERNING REAL ESTATE PROFESSIONALS AND METAHOMES BROKERAGE
- Real Estate Professionals listed on the Platform are entitled to list Real Estate Properties, engage with End-Users, and facilitate Real Estate Property transactions in accordance with the guidelines, policies of the Platform, and Applicable Laws.
- Real Estate Professional registration and requirements:
- Real Estate Professionals must provide accurate and current information during registration and the signing of the Advertising Agreement with the Company;
- By signing the Advertising Agreement, the Real Estate Professionals agree that MetaHomes Brokerage will manage the End-User referral.
- Communication and Referral Process:
- Following an End-User's expression of interest, the customer support team will hand the referral to MetaHomes Brokerage. MetaHomes Brokerage will then contact the Listing Real Estate Professional to finalize the transaction;
- To facilitate a smooth referral process and protect client data, the Real Estate Professional is required to execute separate Commission and Referral Arrangement agreements with MetaHomes Brokerage;
- MetaHomes Brokerage reserves the right to manage the entire referral process and ensure compliance with all legal frameworks for property transactions.
- Real Estate Professional’s confidentiality and data protection:
- Real Estate Professionals are required to maintain the confidentiality of all End-User data obtained via the Platform. The confidentiality of End-User data is paramount to maintaining the integrity of MetaHomes' services. Sharing End-User data with third parties without the explicit consent of the End-User and the Company is strictly prohibited. The Company will provide End-User data to the Real Estate Professional solely for the purpose of facilitating the real estate transaction as outlined in these Terms.
25.5 Property Change and Commission Waiver:
- During the process of investigating or visiting a Listed Real Estate Property, if the End-User decides to drop their interest in the original Real Estate Property and express a preference for another Real Estate Property listed on the Platform, MetaHomes Brokerage or the Company will have no authority or responsibility over the change of property choice. In such cases, the Company nor MetaHomes Brokerage will be held liable or responsible for any impact on the Commission and Referral Arrangement;
- The commission as outlined in the Commission and Referral Arrangement, will only take effect upon the successful completion of a property transaction involving the End-User and the original Real Estate Property referred through the Platform. If the End-User’s preference shifts to a different Real Estate Property, the Commission and Referral Arrangement for the original Real Estate Property will be waived, and the Real Estate Professional will have no obligation to facilitate or be entitled to any commission for the new Real Estate Property;
- Any new transactions related to a change in property preference will require a separate Commission and Referral Arrangement, signed by the relevant parties involved.
25.6 Solicitation:
- Real Estate Professionals agree not to directly or indirectly solicit, contact, or attempt to engage in any Real Estate Property transactions with an End-User referred to through the Platform, outside of the official Platform and process. This includes, but is not limited to, bypassing MetaHomes' customer support team or the MetaHomes Brokerage process to close a purchase or transaction;
- For the purpose of this section, "soliciting" refers to any attempt to initiate, facilitate, or close a Real Estate Property transaction, directly or indirectly, with an End-User outside the referral and engagement process through the Platform. This includes initiating contact, offering services, or entering into agreements with the End-User without the Company’s prior knowledge or approval;
- Any Real Estate Professional found to be in violation of this solicitation section, by attempting to independently close a transaction or circumvent the established referral process, will be considered in breach of these Terms. Such actions will result in immediate suspension or termination of the Real Estate Professional's access to the Platform and may lead to legal action for breach the Commission and Referral Arrangement signed between the parties;
- The Company reserves the right to take all necessary legal action to enforce these Terms, including seeking financial compensation for damages caused by the breach. This may include pursuing legal remedies, such as claims for lost commissions or any other damages resulting from the violation.
25.7 Conflict of Interest:
- As a Real Estate Professional, you acknowledge that the Platform also operates through MetaHomes Brokerage. This dual role may, at times, create situations where MetaHomes Brokerage competes with your Listings or transactions;
- If MetaHomes Brokerage is the registered agent for a Real Estate Property listed on the Platform, it will exclusively handle that transaction. In such cases, other Real Estate Professionals will not participate unless expressly agreed otherwise;
- The Company is committed to ensuring transparency in all transactions, and any conflict of interest will be disclosed and managed in a fair and ethical manner. If you have any concerns regarding potential conflicts, you agree to notify the Company immediately;
- By partnering with the Platform, Real Estate Professionals gain exclusive access to a dynamic and expansive brokerage network with extensive support, helping to enhance their transaction capabilities while ensuring that all activities comply with Applicable Laws.
- ADDITIONAL TERMS GOVERNING MERCHANTS AND END-USERS
- Merchants and End-Users agree to be governed by the following additional terms:
- By using MetaHomes Life Services, Merchants agree to offer their services in compliance with the Applicable Laws. Merchants must maintain and provide the Company the necessary documents including, but not limited to, permits, No Objection Certificates (NOCs), qualifications, licenses, and insurance certificates to offer the services listed in their Trade License within the applicable Emirate;
- Merchants are responsible for ensuring that their service offerings are accurately represented on the MetaHomes Life Services Platform. This includes providing detailed descriptions, availability, pricing, and any other relevant information necessary for End-Users to make informed decisions;
- Merchants who provide fewer services on the Platform than what is specified on their trade license are required to sign and submit a declaration to the Company. Furthermore, the Merchant must provide the Company with a formal written notice via email;
- The Company reserves the right to review and approve the Content of Merchants and to remove or amend any MetaHomes Life Services Listing that does not comply with the Platform’s standards or violates any Applicable Laws;
- Once a Merchant completes a service for an End-User, they must update their dashboard. Additionally, the End-User will mark the “service completed” via the MetaHomes mobile application;
- In the event the End-User does not mark “service completed”, the Merchant, with the express consent of the End-User, will provide "service images" to the Company upon the completion of a service (in JPG/PNG format). The End-User hereby agrees to permit the Merchant to take necessary images, which may include, but is not limited to, images of the End-User's property, for the purpose of complying with these Terms and Privacy Policy available through the Platform;
- The "service images" will be accessible to the End-User through their order details page;
- The Service Fee charged by the Company will be deducted from payments made by End-Users who book services via the Platform. The Service Fee will cover the provision of Platform services including, but not limited to, customer support, platform maintenance, and other related services;
- To initiate the transfer of the Merchant net amount following the End-User's total payment to the Company, a minimum payout threshold of AED one hundred and fifty (150) must be met. Should the balance fall below this stipulated threshold, the outstanding amount will be rolled over to the subsequent payment cycle, as stipulated in the merchant agreement signed between the Company and the Merchant;
- Merchants acknowledge and agree that they are solely responsible for the legality, quality, and delivery of their services offered through the Platform;
- In the event of any consumer complaint, dispute, or regulatory violation arising from a Merchant’s services, the Platform will act as a neutral third party to resolve the issues. For any complaints the End-User can reach out to MetaHomes’ support team via support@metahomes.net.
- The Company reserves the right to suspend or terminate a Merchant’s access to the Platform if the Merchant is found to be in violation of any of these Terms or any Applicable Laws;
- The Company makes no warranties regarding the suitability or quality of the services provided by Merchants nor is the Company responsible for the fulfillment of the services by the Merchants.
- The Company shall not be held liable for any consumer protection, product liability, service-related issues, damages, losses, or dissatisfaction arising from the services provided by Merchants;
- By using the Platform, the Merchant agrees that the Company does not independently verify the authenticity or claims of each service and encourages End-Users to verify service details directly with the Merchants;
- Merchants and End-Users agree to comply fully with all Applicable Laws, including, but not limited to UAE Federal Law No. 15 of 2020 on Consumer Protection and UAE Federal Law No. 45 of 2021 on Personal Data Protection, as well as any other relevant laws related to the services they provide or use;
- End-Users further accept that they engage with Merchants and avail services at their own risk. The Company is not responsible for any direct or indirect consequences arising from the services rendered by Merchants;
- Merchants agree to indemnify and hold the Company harmless from any claims, damages, or liabilities arising from their provision of services or any failure to meet their obligations under Applicable Laws or these Terms;
- For detailed information regarding cancellation and refund procedures under MetaHomes Life Services, please refer to the Cancellation and Refund Policy available on the Platform.
- PAYMENT TERMS GOVERNING END-USERS
- Online Booking and Payment Requirements:
- All bookings on the Platform require full payment to be completed at the time of booking. We do not offer "pay-per-booking" listings. Transactions for all bookings must be processed through the Platform using the available payment methods. We accept Visa, Union Pay, American Express or MasterCard debit and credit cards in AED. Only after a full payment is made will the booking be confirmed and processed.
- Payments for bookings made via the Platform will be processed through MetaHomes’ integrated payment system or via third-party payment providers as detailed during the booking process.
- For payments processed by third-party payment providers, such payments are subject to the terms and conditions and privacy policies of the respective third-party provider. The Company is not responsible for any issues arising from the use of third-party payment providers, and End-Users should review the relevant terms before making the payments.
- Once the payment is completed, the confirmation notification will be sent to the End-User via email within twenty-four (24) hours of receipt.
28.1 All Users and End-Users of the Platform agree not to post, upload, or transmit any Content that is defamatory, libelous, slanderous, or otherwise harmful to the reputation of any individual, User or the Company. This includes all forms of written, spoken, or visual statements that might unjustly damage the reputation of another person or entity, whether on the Platform itself, through social media, or in any other public communication connected with the Platform.
28.2 Users are solely responsible for all Content they upload, post, email, transmit, or otherwise make available via the Platform. The Company assumes no responsibility for Content posted by Users and does not pre-screen such Content. However, the Company reserves the right to review and, if necessary, remove any Content that violates this section without prior notice.
28.3 Constructive reviews of services or properties may only be submitted through the Platform’s designated review features and must be expressed in fair, respectful, and professional language. Any attempt to misuse reviews or other communication channels for defamatory purposes is strictly prohibited.
28.4 The Company encourages all parties to report any Content they believe to be defamatory or in violation of these Terms. The Company will review such reports promptly and act in accordance with these Terms, Platform policies, and Applicable Law.
28.5 Any User who violates this section may have their access to the Platform suspended or terminated. In addition, the Company and/or the affected party reserve the right to pursue all remedies available under Applicable Law, including taking legal action in accordance with the UAE Penal Code and other relevant legislation.
28.6 The failure of the Company to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. If any provision of this section is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the remaining provisions shall remain in full force and effect.
- MetaHomes, including all Content, software, functions, materials, and information available on or accessed through the Platform, is provided on an “as-is” basis. To the fullest extent permitted by law, the Company makes no representations or warranties of any kind, express or implied, with respect to the accuracy, completeness, reliability, or availability of the Content, services, software, or any third-party links provided through the Platform. This includes, but is not limited to, any warranties related to merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
- You acknowledge that MetaHomes is a Platform for Listing Real Estate Properties and services offered through the MetaHomes Life Services Platform. We do not guarantee, nor are we responsible for, the accuracy, quality, or safety of any Real Estate Property or service listed by Users. The Company does not review, verify, or endorse any Listings provided by Users.
- Any transaction related to a Real Estate Property purchase between the User and the End-User, the User and End-User agree not to hold the Company responsible for any disputes, losses, or damages arising from these transactions.
- While we strive to ensure the payment process is secure, efficient, and transparent, the Company is not liable for any issues related to the payment process, including, but not limited to, payment failures, delays, fraudulent transactions, or payment disputes. You acknowledge that any issues related to payment, including disputes over charges, fraud, or other payment-related concerns, should be resolved directly with the payment provider, financial institution, or third-party payment processor.
- The Company is responsible for processing the transaction and deducting the applicable Service Fee at the time of payment acceptance. However, we do not assume liability for any issues that may arise beyond this process, such as errors in the payment system, delays in transaction processing, or any discrepancies in the amount charged. By using the Platform payment gateway, the Merchant agrees that the Company will not be held responsible for any losses, damages, or inconvenience incurred during the payment process. You agree to address any payment-related disputes directly with the relevant payment provider or financial institution.
- The Company does not guarantee the safety, quality, or accuracy of any Listings on the Platform. All Listings, including, but not limited to, vacation homes, rental properties, and other services, are the sole responsibility of the User. The Company is not liable for any damages, accidents, injuries, or other issues that may arise from a Real Estate Property or service listed on the Platform. End-Users are advised to exercise caution and conduct their own due diligence before engaging in any transactions.
- The Company uses AI-driven search algorithms to display and recommend Real Estate Properties and services listed by Users. While we strive to offer relevant search results and recommendations, we do not guarantee that the AI-driven search engine will always display the most suitable or accurate Real Estate Properties or services. End-Users should independently verify the details of any Listing before making any purchase or rental decision.
- The Platform may contain links to third-party websites or services, including social media sites, external payment gateways, or third-party booking platforms. These links are provided for convenience only and do not constitute an endorsement or approval of the content or services provided on those websites. The Company is not responsible for any third-party websites or services, and you access them at your own risk. We encourage End-Users to review the terms, conditions, and privacy policies of any third-party websites you visit.
- The Company does not warrant or guarantee the safety, accessibility, or quality of any destination, Real Estate Property, or service listed on the Platform. You acknowledge that by using the Platform to book or rent Real Estate Properties or services, you do so at your own risk. The Company is not liable for any injuries, damages, losses, or inconveniences resulting from your travel to a destination or use of any Real Estate Property or service listed on the Platform.
- You acknowledge and agree that communications, including User-Generated Content and other information submitted to the Company, are not confidential. Any information or Content submitted through the Platform may be intercepted or read by third parties. The Company is not responsible for the security or privacy of any communications sent to or from the Platform.
- By posting Content on the Platform, such as Real Estate Property listings or service offerings, no fiduciary, contractual, or other implied relationship is created between you and the Company, except as expressly outlined in these Terms.
- To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data arising out of or related to your use of the Platform, even if the Company has been made you aware of the possibility of such damages. In no event shall the Company’s total liability exceed the amount you have paid to the Company for the use of the Platform during the twelve (12) months preceding the event giving rise to the claim.
- In no event will the Company, or its subsidiaries, affiliates, officers, directors, consultants, agents, and/or employees, or any third-party provider of a service or tool offered on any site of a member of MetaHomes (each a “Third-Party Provider”), be liable for any lost profits or any indirect, consequential, special, incidental, or punitive damages arising out of, based on, or resulting from (A) the Platform, (B) these Terms, (C) any breach of these Terms by you or a third party, (D) use of the site, tools, or services we provide, or any third-party provider provides, related to the business we operate on the Platform, by you or any third party, (E) any User-Generated Content, (F) interaction between the Platform and any third-party site, including without limitation a social media site, facilitated by a tool or service on the Platform, and/or (G) any actual or attempted communication or transaction, including without limitation, any payment transaction (even if we or any third-party provider receives a fee in connection therewith) between Users, in each case, even if we have been advised of the possibility of such damages.
- These limitations and exclusions apply without regard to whether the damages arise from (A) breach of contract, (B) breach of warranty, (C) strict liability, (D) tort, (E) negligence, or (F) any other cause of action, to the maximum extent such exclusion and limitations are not prohibited by Applicable Law.
- If you are dissatisfied with the Platform, you do not agree with any part of these Terms, or have any other dispute or claim with or against us, any third-party provider, then your sole and exclusive remedy against us is to discontinue using the Platform.
31.1 These Terms shall be governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC), UAE. The DIFC courts shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
- NOTICES TO USERS AND END-USERS
- When the Company needs to send any types of notices or newsletters to Users and End-Users, it will be sent to the email address you provided during registration of your account on our Platform or primary email enlisted on the Platform. Notices shall be deemed given upon receipt or twenty-four (24) hours after the email is sent, unless the sending party is notified that the email address is invalid.
- Alternatively, if any notice may be sent by certified mail, postage prepaid, and return receipt requested, to any physical address you have provided. Such notice shall be deemed given three (3) days after mailing to a physical address and one day after mailing to an electronic address.
- PLATFORM CHANGES, SPECIAL PROGRAMS, AND TERM UPDATES
- The Company reserves the right, at its sole discretion, to change, suspend, or discontinue any aspect of the Platform at any time, including its features, database, or Content, without prior notice or liability. We may impose limits on certain features or restrict your access to parts of the Platform, including suspension or termination of your account, as necessary.
- In addition, the Company may offer special programs, products, or services that have their own separate terms and conditions, which will apply in place of or in addition to these general Terms. These separate terms may supersede or supplement the general Terms, depending on the nature of the program, product, or service. By participating in such programs or using such products or services, you agree to abide by both the general Terms and any specific terms that apply to the particular program, product, or service.
- The Company may also amend these Terms at any time, and such amendments will be posted on the Platform with an updated "last updated" date. The revised Terms will become effective immediately upon posting. It is the responsibility of Users and End-Users to regularly review the Terms to ensure they are aware of any updates. By continuing to use the Platform, you agree to be bound by the updated Terms.
- Additionally, the Company reserves the right, but assumes no obligation, to agree to different or conflicting terms with any User. Any conflicting terms shall only be enforceable if specifically agreed to by the Company.
- RETENTION OF TERMS AND AGREEMENT STRUCTURE
34.1 The Company does not separately file the Terms entered into by each User. It is your responsibility to retain a copy of these Terms for your records. By using the Platform, you agree to comply with these Terms, which govern your use of the Platform. In addition to these Terms, the Company may enter into separate agreements for specific terms subject to the services offered on the Platform. In the event of any conflict between the separate agreements and these Terms, the specific agreements will govern those services, but these Terms shall remain the primary terms applicable to the general use of the Platform.
- DISTRIBUTION OF LISTINGS TO THIRD-PARTY WEBSITES
- The Company may, at its discretion, distribute Listings and Content provided by Users to third-party websites. This distribution is intended to help the Users gain broader exposure for their Real Estate Properties or services.
- INDEMNITY FOR VIOLATION OF TERMS
- By using the Platform, Users and End-Users agree to indemnify, defend, and hold harmless the Company, its affiliated companies, officers, directors, employees, and agents from any third-party claims, damages, losses, fines, penalties, or expenses (including reasonable legal and accounting fees) arising out of or resulting from:
- The User’s breach of these Terms or any other agreements referenced herein;
- Any violation by the User of Applicable Laws or third-party rights;
- The User’s or End-User’s misuse of the Platform, including any activities that are deemed outside the normal or acceptable use of the Platform.
- This indemnification applies to any legal action brought by third parties as a result of the User’s or End-User’s actions, whether those actions occur within or outside of the scope of their use of the Platform. Users and End-Users are responsible for all costs, including legal fees, incurred by the Company in defending such claims.
- The Company shall not engage in any trade or provide any services to countries subject to sanctions by OFAC or the UAE, nor to any entity or individual on the UAE's Terrorist Financing List.
- If any provision of these Terms is found to be invalid, unenforceable, or contrary to Applicable Law, the remaining provisions shall continue in full force and effect.
- These Terms, along with any supplemental terms disclosed at the time of service, represent the entire agreement between the Company and Users, and End-Users accessing or using the Platform. This includes, but is not limited to, any separate agreements that may be executed with Users which form an integral part of these Terms.
- By using the Platform, Users and End-Users acknowledge that these Terms, together with any applicable supplemental agreements, constitute the complete and exclusive understanding between the parties and supersede any prior agreements or understandings, whether written or oral, relating to the use of the Platform.
